Welcome to FestiFowl

These Terms and Conditions ("Terms") govern your use of FestiFowl, a holiday decoration competition platform. By using our platform, you agree to these Terms.

Using FestiFowl

Eligibility

You must be at least 18 years old to use FestiFowl. By using the platform, you represent that you meet this requirement.

Account Registration

While you can upload photos without an account, creating an account lets you manage and delete your submissions. You are responsible for maintaining the security of your account.

Acceptable Use

You agree not to:

  • Upload photos containing inappropriate, offensive, or illegal content
  • Upload photos that violate others' privacy or intellectual property rights
  • Use the platform for any illegal purpose
  • Attempt to manipulate scores or game the system
  • Upload spam or unrelated content

Photo Uploads and Content Rights

Your Content

When you upload a photo to FestiFowl:

  • You retain ownership of your original photo
  • You grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your photo on our platform and in connection with our services
  • This license allows us to show your photo on the leaderboard, map, and any promotional materials
  • You may revoke this license at any time by deleting your photo

Content Responsibility

You represent and warrant that:

  • You have the right to upload the photo (it's your photo or you have permission)
  • The photo does not infringe on anyone's rights
  • You have permission to photograph private property if applicable

Content Removal

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

Photo Deletion and Removal Requests

Deleting Your Own Photos

If you uploaded a photo, you can delete it anytime from your account dashboard. Deletion is immediate and permanent.

Reporting Photos

If you see a photo of your property that you didn't upload and wish to have it removed:

  1. Click the "Report" button on the photo
  2. Select "This is my photo" or "I'm in this photo"
  3. Provide your email and a brief explanation
  4. We will review your request and remove the photo promptly

We take removal requests seriously and aim to respond within 48 hours.

AI Scoring

Our AI system analyzes photos to score holiday decorations. The scoring is automated and considers factors like:

  • Holiday spirit and festiveness
  • Quality and presentation
  • Creativity and uniqueness
  • Overall visual appeal

Photos are scored by a third-party AI provider, currently the Google Gemini API; see our Privacy Policy for details. Scores are generated by AI and are meant for fun. We make no guarantees about scoring accuracy or consistency.

Limitation of Liability

No Warranty

FestiFowl is provided "as is" without warranties of any kind. We do not guarantee that the platform will be error-free or uninterrupted.

Limitation of Damages

To the fullest extent permitted by law, FestiFowl shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

Indemnification

You agree to indemnify and hold harmless FestiFowl and its operators from any claims arising from your use of the platform or violation of these Terms.

Privacy

Your use of FestiFowl is also governed by our Privacy Policy. Please review it to understand how we collect and use your information.

Changes to These Terms

We may update these Terms from time to time. Continued use of FestiFowl after changes constitutes acceptance of the new Terms.

Termination

We may terminate or suspend your access to FestiFowl at any time, without prior notice, for violations of these Terms or any other reason.
